Here are the 7 biggest mistakes most people make after being arrested for DUI:

1.
NOT TAKING THE MATTER SERIOUSLY.

    Your DUI conviction may stay on your California criminal record for the rest of your life. The California DMV will track you for 10 years to make sure your license is suspended if you get a second DUI, or if you do not satisfy all the court fines and penalties.  Your vehicle insurance premium will increase, or your insurance company may cancel your policy.

2. NOT HIRING A DUI ATTORNEY. 

    California DUI laws are complex and confusing, with new laws constantly going in effect. You must raise the right defenses and arguments at the proper time to make the best impact. A DUI case that was winnable can become a loser, if the proper facts are not discussed with the prosecutor. It is also a costly mistake to think that speaking to many lawyers will help you handle your DUI case on your own. The prosecutor will not discuss the merits of your case with a non attorney and may be in violation of California ethic rules if the merits or defenses are discussed.

3. HIRING AN ATTORNEY BASED ON THE AMOUNT OF THE FEE ALONE. 

    Attorneys must earn enough for the time spent on your case. The fact is that a cheap attorney cannot possibly spend the time needed to fully evaluate the facts, to develop a DUI defense strategy, and to attend numerous court appearances. Experienced DUI attorneys ask for a reasonable and flat fee, and will ultimately save you money, time and stress.

4. NOT BEING REPRESENTED BY A DUI ATTORNEY AT THE DMV HEARING. 

       DUI attorneys know what additional rights to ask for from the DMV, aside from requesting a hearing.  Having a DUI attorney to present your side of the story, backed up by legal defenses, increase your chance of winning, and not having your driving privilege taken away. If you lose the hearing, you  may get your driving privilege back on a restricted basis - being allowed to drive to work and back, and to drive while working.

5. TAKING THE PROSECUTORS FIRST OFFER.

    If you appear in court by yourself, the prosecutor will give you an initial offer to settle your DUI case. The prosecutor may even say the deal is a take it now offer, or penalties later will get harsher. This first offer is not a bargain, but a threat to scare you. If you take this first offer, you make a costly mistake.  If you do not take this first offer, unfortunately you still make a costly mistake. As two old sayings go, "you don't get a second chance to make a good first impression", and "you don't get a second bite of the apple". What I mean by this is when you later hire a DUI lawyer, the prosecutor's future offers may not have significant improvements. As a result, almost all experienced DUI lawyers may be very reluctant to take your case. Your DUI lawyer may now only be able to make small improvements from the initial offer, because the prosecutor's ego and reputation is attached to the initial offer. For this reason, it is important that you have representation from the very beginning court appearance. This gives your DUI lawyer a "clean slate" to work from, and to have your ultimate offer based on tough negotiations.

6. FAILING TO APPEAR IN COURT.

    Not appearing in court at all, or not responding after your name is called, will result in a warrant for your arrest being issued by the judge. The police may come to your home or place of employment to arrest you, or you will be arrested if stopped for a minor traffic infraction. This results in spending time in jail, and posting a bond to guarantee future appearances.   

7. TALKING TO ANYONE OTHER THAN A DUI ATTORNEY ABOUT YOUR CASE.

    Anything you say to the police, the people at the jail, or to the court staff can be used against you.
Even discussing your arrest with family and friends carries the risk of turning them into involuntary witnesses against you. (A spouse being the exception.)  It is in your best interests to write down the details, and to fully discuss the details with your DUI attorney. This is especially important if you get an over-worked prosecutor, who in turn uses reports from an inexperienced or over-zealous police officer, which in turn causes your DUI case to be over-prosecuted resulting in harsher penalties. This happens more times than you would believe. Only an attorney focused on
DUI defense can properly defend you, and get the best possible outcome.
