Here is a brief summary in plain English of the most important California Vehicle Code laws on DUI. 

Vehicle Code Section 23152 (a)  --- It is unlawful for any person under the influence of alcohol or drugs to drive a vehicle.

Vehicle Code Section 23152 (b) --- It is unlawful for any person who has 0.08% or more of alcohol to drive a vehicle.

Vehicle Code Section 23152 (c) --- It is unlawful for any person who is addicted to any drug to drive a vehicle.

Vehicle Code Section 23152 (d) --- It is unlawful for any person who has 0.04% or more of alcohol to drive a commercial vehicle.

Vehicle Code Section 23153 (a) --- It is unlawful for any person under the influence of alcohol or drugs to drive a vehicle which causes bodily injury to another person.

Vehicle Code Section 23153 (b) --- It is unlawful for any person who has 0.08% or more of alcohol to drive a vehicle which causes bodily injury to another person.
 
Vehicle Code Section 23153 (d) --- It is unlawful for any person who has 0.04% or more of alcohol to drive a commercial vehicle which causes bodily injury to another person.

Vehicle Code Section 23520 (a) --- An alcohol education program shall be required of any person who violates Section 23152 or 23153.

Vehicle Code Section 23536 (a) --- County jail from 2 days to 6 months and a base fine from $390 to $1,000 shall be required for any person who violates Section 23152.  (note: fines and jail vary from county to county, plus a penalty assessment tax will increase the base fine an additional three times.)

Vehicle Code Section 23536 (d) --- The court may not allow the driver to get a restricted driver's license if the court determines the driver is a traffic safety or public safety risk.

Vehicle Code Section 23700 (a) --- A person will be required to install an ignition interlock device as a condition of getting a restricted driver's license, or being reissued a driver's license, or being reinstated following a DUI. The person will be required to have the installation for a length of time from 5 months to 48 months, depending upon the number of prior convictions.
(note: This section shall become effective July 1, 2010 in Los Angeles County.)


The Vehicle Code Sections above represent the main laws on DUI. However, there are additional Vehicle Code Sections on
